Repealed.

for Charles County, sub-title "Roads," and Chap-
ter four hundred and fitty-two of Acts passed ses-
sion eighteen hnudred and sixty-eight, entitled an
"Act to repeal sections ninety-six to one hundred
and nine inclusive, of the Code of Public Local
Laws of Maryland, for Charles County, under the
head of Roads, and to enact the following in lieu
thereof; and to provide for a Road system for St.
Mary's County," be and the same is hereby re-
pealed.

In force.

Sec. 2. And be it enacted, That this Act shall
take effect from its passage.

Approved March 31, 1870.

 

CHAPTER 140.

 

AN ACT to extend the Jurisdiction of Justices of
the Peace for Wicomico County to cases of As-
sault and Battery.

Jurisdiction
of Justices.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Justices of the Peace for
Wicomico County shall have jurisdiction over, and
may take cognizance of actions of assault and bat-
tery, where the damages claimed do not exceed the
sum of one hundred dollars, and also criminal
jurisdiction in all cases of assault and battery com-
mitted in said county, unless it should appear to
the said Justices of the Peace, upon the hearing of
the case, that the said assault and battery was
committed with intent to kill.

Appeal.

Sec. 2. And be it enacted, That in all cases here-
after tried under this Act before Justices of the
Peace for said county, either party shall be allowed
an appeal to the Circuit Court for Wicomico
County, where they shall be tried de nova, and all
such appeals shall be taken in such manner as is
now provided for by law in others cases of appeals
from judgments of Justices of the Peace.

In force.

Sec. 3. And be it enacted, That this Act shall
take effect from the date of its passage.
