LAWS OF MARYLAND.

Catch Oysters

residents of Dorchester County to catch or take
oysters with a scoop, in boats or canoes not exceed-
ing five tons burthen, according to Custom House
measurement, in Horiga River and that part of
Fishing Bay which lies to the southward and west-
ward of a straight line drawn from the middle of
the mouth of Tedious Creek to Clay Island Light
House, and in the waters of the said county to the

Limits.

southward and westward of said Fishing Bay and
Honga River upon obtaining license therefor, as
hereinafter directed; provided, that nothing herein
contained shall authorize the taking or catching
of oysters with scoops between the first day of
May and the first day of October, in each year.

Must have li-
cense.

Sec. 2. And be it enacted, That any resident of
said county owning or having in his possession
any canoe or other boat not exceeding five tons
burthen, according to Custom House measure-
ment, and desiring to use the said boat or canoe
in taking or catching oysters with, scoops in any
of the waters of said county, described in Section
one, shall first obtain, by application to the Clerk
of the Circuit Court for said county, a license
therefor, and such license shall have effect from
the first day of June, in the year in which it may
have been obtained, to the first day of June next
succeeding; provided, that such license shall not
authorize the use of said canoe or boat in the
taking or catching of oysters in any creek, river,
cove, inlet, bay or sound other than in the herein-
before mentioned waters.

Rates.

Sec. 3. And be it enacted, That each and every
license to take or catch oysters with scoops, shall
state the name and residence of the person to
whom the same is to be granted, the number,
together with the length to be obtained by top or
over all measurement, of the canoe or other boat
to be licensed, the county in which the same is to
be used, and the period at which said license was
to expire, and every applicant for such license shall
pay to the Clerk of the said Court for said county
and before the issuing and delivery of the same,
according to the following rates, viz; For every
canoe or boat measuring in length twenty feet or
less, the sum of five dollars; measuring from
twenty to twenty-five feet, the sum of eight dol-
