extend to and embrace the power to acquire and
hold all lands adjoining the track of said Road
not exceeding five acres in any one place which
the said Company may deem necessary or conve-
nient for depots or any other purposes required by
the legitimate business of the said Company; and
the mode prescribed in said original Act for the
assessment of damages and condemnation of land,
shall apply to all land taken and occupied under
this Act.

Sec. 2. And be it enacted, That the Commission-
ers to assess damages of land owners, authorized
by the original Act, to which this a supplement,

in estimating the damages to which any land own-
ers may be entitled under said Act, or its supple-
ments, shall take into the estimate the benefits
resulting to said owner or owners from conducting
such Railroad through, along or near to the prop-
erty of said owner or owners, but only in extin-
guishment of the claim for damages; and the said
Commissioners, in the certificate which they shall
return to the Clerk of the Circuit Court for Wor-
cester County, in addition to a description of the
lands condemned, shall include also the quantity

or duration of the interest in the same, valued by
them for the' Company, and the said valuation,
when paid or tendered to the owner or owners of
said property, or his, her or their legal represen-
tatives, or paid to the Clerk of the said Court in
the manner and upon the conditions prescribed in
the said original Act, shall entitle the said Com-
pany absolutely to the estate or interest in the
same thus valued, as fully as if it had been con-
veyed by the owner or owners of the same.

Power to lay
tracks.
|
Sec. 3. And be it enacted, That it shall and may
be lawful, and the said Railroad Company is
hereby authorized to introduce, construct and Jay
down the track of their said Road into, through
and across the corporate limits of the town of
Snow Hill, and for that purpose to lay down a
single track through or across any of the streets
or alleys of the said town, and the said Company
may grade any street or alley through or across
which it may lay its track, so as to make it con-
venient or suitable for the construction or working
of their said Road; provided, that if in the grad-
