said Commission shall file the same with the Comptroller of
the Treasury, and shall furnish the President of the said
Railroad Company with a copy thereof, and if the said Com-
pany shall fail to pay the said amount, so ascertained to be
due into the Treasury of the State for the space of thirty
days after a copy of said ascertainment shall be furnished
said Company through its President as aforesaid, the Gov-
ernor be and he is hereby requested to instruct the Attor-
ney General to institute proper legal proceedings to enforce
the payment of said amount.

Resolved, That if on investigation and adjustment of ac-
counts it shall appear that the State of Maryland is indebted
to the Baltimore and Ohio Railroad Company, the Comp-
troller is ,hereby directed to issue his warrant to the Treas-
urer to pay to the order of the said Baltimore and Ohio Rail-
road Company out of any unappropriated moneys in the
Treasury the amount they shall have determined to be due
said Company.

Resolved, That said Commissioners shall be allowed ten
dollars a day each, for their services, and the accountant they
may employ, such amount per diem as they may agree
for, which said several amounts shall be paid said Commis-
sion by the Treasurer, on the warrant of the Comptroller,
and said accountant shall be paid by the Treasurer, on the
warrant of the Comptroller, such amount as the Chairman of
this Commission shall certify in a written, order to be due
him.

Pending the consideration of said amendment,
On motion by Mr. Fields,
The Senate adjourned.

THURSDAY, March 24, 1870, 8 o'clock, P. M.
The Senate met pursuant to adjournment.
Present at roll call, the following Senators :

Messrs. President, Biggs, Browne, Carroll, Earle, Fields,
Grove, Henkle, Henry, Hyland, Jump, Malone, Sellman,
Snyder, Stephenson, Welch and Wilson—17.

The Senate proceeded to the consideration of the unfinished
business of the morning session.

The question being upon the adoption of the amendment
submitted by Mr. Earle to the Senate Joint Resolutions
