pany one-fifth of the whole amount which may be received
for the transportation of passengers between the cities of Bal-
timore and Washington and intermediate points, on said
Road by said Company, and all other Acts, or parts of Acts,
inconsistent with this section be and the same are hereby re-
pealed, and the Baltimore and Ohio Railroad Company in
hereby forever released and discharged from the collec-
tion and payment of one-fifth of the whole amount by it
received for the transportation of passengers on or over its
Railroad, between Baltimore and Washington, or on or
over any part thereof, into the Treasury for the use of
the State ; provided, that the Baltimore and Ohio Railroad
Company snail first pay over to the Treasurer of the State
the amount collected on this account and in their hands,
since the first day of July, 1868, and which may accrue up
to the time of the passage of this Act ; and provided further,
that the Baltimore and Ohio Railroad Company shall execute
and file, in the office of the Comptroller of this State, a re-
lease to the State of Maryland of any and all claims and de-
mands of the said Company for or on account of any payment
by it made, or alleged to have been made, for or on account of
the interest on any part of the public debt of this State, and
also shall execute and file its written obligation, under seal,
and signed by its President, to pay into the Treasury of the
State the sum of fifty thousand dollars per annum, the same
to be paid. semi-annually, on the first days of January and.
July in each and every year, until such time as the Balti-
more and Potomac Railroad Company shall complete its
Washington Branch, and commence carrying passengers be-
tween the cities of Baltimore and Washington.

Resolved, That this Act shall not take effect until the Bal-
timore and Ohio Railroad Company shall have complied with
all its provisions.

Resolved, That if the Baltimore and Ohio Railroad Com-
pany shall, at the end of ten days after the passage of this
law, decline compliance with its provisions, then and in that
event John Lee Carroll, William M. Merrick and James L.
McLane, be and they are hereby constituted and appointed a,
commission to ascertain the amount of indebtedness of said
Baltimore and Ohio Railroad Company to the State of Mary-
land; and. in making such ascertainment, such Commission
shall investigate and consider all items of indebtedness by
said Railroad Company to the State, and shall also investi-
gate and consider any claim which the said Railroad Com-
pany has or asserts against the said State ; and that said Com-
mission have power to employ an expert accountant to
assist them in said investigation and to send for persona and
papers, and to have free access to the books of the said Com-
pany, and immediately on said ascertainment being made,
