1870.] OF THE SENATE. 225JOINT RESOLUTIONS. Be it resolved by the General Assembly of Maryland, That
a Committee, consisting of four members of the House and
three of the Senate, to be appointed by the Speaker of the
House and the President of the Senate respectively, be, and
the same are hereby constituted and appointed a Joint Spe-
cial Committee, to whom shall be referred all matters of ac-
count in dispute, and all differences between the State of
Maryland and the Baltimore and Ohio Railroad, relative to
the transportation of passengers, said Committee to have
power to send for persons and papers, and to employ a com-
petent accountant to aid them in their deliberations, and re-
port thereon to this General Assembly, for their action, with-
in fifteen days after the passage of these resolutions. And be it further resolved, That upon the failure of the
Baltimore and Ohio Railroad Company to pay into the Trea-
sury of the State, the amount which said Committee may re-
port to be due the State by the said Company, for the space
of twenty days after the adoption of the report of this Com-
mittee by the General Assembly, then, and in that event,
the Attorney General is hereby directed forthwith to insti-
tute proceedings, by writ of scire facias, in the name of the
State of Maryland, against the Baltimore and Ohio Railroad
Company, to ascertain whether the charter, and corporate
franchises and privileges of said Company, ought not, by
reason of misuser and abuse of its franchises and privileges,
bevacated and annulled. And be it further resolved, That the Governor is hereby
authorized to employ counsel to aid the Attorney General in
prosecuting the said writ of scire facias Also returned the Senate bill entitled an Act to author-
ize and empower the County Commissioners of Worcester
county to purchase sites, and to erect Public Buildings there-
on for the use of said county, and to issue bonds on the
credit of said county, to carry into effect the provisions of
this Act. Endorsed, "Beported unfavorably from a Select Commit-
tee, and report adopted." On motion by Mr. Clarke,
Said bill was ordered to lie over. The Senate bill entitled an Act to extend the charter of
the Baltimore and Potomac Railroad Company, Was read the third time and passed by yeas and nays, as
