Kimmel, Mr. Earle moved that the vote by which the amendment
to section seven in line thirty-two, be reconsidered. Mr. Henkle called for the yeas and nays.

ted by Mr. Snyder. Mr. Snyder withdrew his amendment.
The section as amended was then adopted.
Mr. Earle submitted the following amendment : Amend by striking out section nine, and insert the follow-
ing sections: SEC. 9. And be it enacted, That the capital stock of the
said Baltimore and Potomac Railroad Company shall be ex-
empt from the imposition of any tax on burthen, but the
said Company shall pay into the Treasury of this State, on
the first Monday of January and July in each and every
year after it shall have commenced the transportation of
passengers from Baltimore to Washington, one-fifth part of
the whole amount wliich may be received for the transporta-
tion of passengers between Baltimore and Washington, or
on, or over its railroad between Baltimore and Washington
during the six months preceding ; and it shall be the duty of
the President of the said Baltimore and Potomac Railroad
Company, to exhibit on oath or affirmation to the General
Assembly, at each session thereof, and within one week after 12
