The Maryland Health and Higher Educational
Facilities Authority was created in 1970 (Chapter
408, Acts of 1970). The Authority was established
to enable private non-profit health and higher ed-
ucational facilities to use the Authority as a vehi-
cle to issue tax-exempt bonds and thereby pay a
lower rate of interest.

The Authority consists of nine members. One
serves ex officio and eight are appointed to five-
year terms by the Governor. The Governor
designates the chairperson and the vice-chairper-
son. The Authority appoints the Executive Direc-
tor (Code 1957, Art. 43C).

The Health Claims Arbitration Office was estab-
lished in 1976 (Chapter 235, Acts of 1976). Any
person asserting a claim due to medical injury
against a health care provider for damages in ex-
cess of $10,000 must file the claim with the
Health Claims Arbitration Office. The Director is
responsible for notifying all affected parties and
for supplying a list of qualified arbitrators, six
from each of three categories. From each of these
categories one mutually agreed upon arbitrator is
chosen to sit on a three-person arbitration panel.
That panel then must determine the issue of liabil-
ity with respect to the claim and, if it determines
that a health care provider is liable, it must con-
sider and assess appropriate damages. The deci-
sion of the arbitration panel is final, unless re-
jected by any party, in which case the rejecting
party must file an appeal action with the Circuit
Court to reverse or modify the award.

The Office is headed by a Director appointed by
the Governor with the advice and consent of the
Senate. The Director is responsible for preparing
three lists of qualified persons willing to serve as
arbitrators of health-care malpractice claims. One
list consists of attorneys, one of health care prov-
iders, and one of persons from the general public
who are neither attorneys, health care providers,
nor in the employ of insurance interests (Code
Courts and Judicial Proceedings Article, sec.
3-2A-03).

The Herring Run Public Watershed Association
Commission was formed in 1978 to provide for re-
gional cooperation of the State, Baltimore City,
and Baltimore County on flood control, water
quality, and watershed management of the Her-
ring Run Public Watershed (Chapter 992, Acts of
1978). The Watershed is the land and water area
from which all water drains to and from the Her-
ring Run. It includes the Herring Run, West Her-
ring Run, Chinquapin Run, Moores Run, and
Armistead Creek.

The Commission consists of nine members.
They include the Secretaries of the Environment,
Natural Resources, and State Planning, or their
designees; two members from Baltimore City se-
lected by the Mayor; two members from Balti-
more County chosen by the County Executive;
and two members named by the Baltimore Re-
gional Planning Council. Of the six county and
city members, at least one is from the county or
city legislative body, and at least one is a General
Assembly member.

The Commission is authorized to appoint an ad-
visory committee of interested citizens (Code Nat-
ural Resources Article, sees. 8-1701 through
8-1706).
