SOCIAL SECURITY DIVISION

The Social Security Division is charged with the
administration of Section 218 of the federal Social
Security Act in accordance with the State's agree-
ment of December 3, 1951, with the U.S. Depart-
ment of Health, Education and Welfare (now the
U.S. Department of Health and Human Services).
The Division serves as the State agent in all mat-
ters pertaining to social security coverage. The
Division also conducts audits to verify certain
State employer Social Security and retirement ex-
penditures.

Originally part of the State Industrial Accident
Commission, the State Accident Fund was estab-
lished in 1914 (Chapter 800, Acts of 1914). It be-
came a distinct agency in 1941 (Chapter 504, Acts
of 1941). The Fund insures those employers who
are unable or elect not to obtain insurance from
private carriers, and who are not self-insurers.
The Fund is also the Worker's Compensation In-
surance carrier for all State employees.

Through the Fund, employers carry insurance
for the payment of claims that may arise from ac-
cidents and injuries to their employees as allowed
under the Workmen's Compensation Law. All ex-
penses of the Fund are paid out of income from

premiums paid and interest on Fund investments.
The State Treasury is prepaid for operating ex-
penses of the Fund.

The Fund is directed by seven commissioners.
They are appointed to five-year terms by the Sec-
retary of Personnel with the approval of the Gov-
ernor (Code 1957, Art. 101, sees. 70-84).

Created in 1985, the State Employees' Health
Insurance Advisory Council advises the Secretary
of Personnel on the implementation, maintenance,
negotiation, and administration of the State Em-
ployees' Health Insurance Program (Chapter 217,
Acts of 1985). The Council also advises the Secre-
tary of Personnel on the procedure for soliciting
bids from health care providers for a contract for
the State Employees' Health Insurance Program.

The Council consists of the Secretary of Person-
nel or designee, and one representative each of the
Department of Budget and Fiscal Planning; De-
partment of Health and Mental Hygiene; Insur-
ance Commissioner; Comptroller of the Treasury;
Maryland Classified Employees Association;
American Federation of State, County, and Mu-
nicipal Employees; Maryland Troopers Associa-
tion; and the public. Members serve two-year
terms. The Governor designates the chairperson.
The Department of Personnel provides adminis-
trative support to the Council (Code 1957, Art.
64A, sec. 48E).
