The Board of Airport Zoning Appeals was cre-
ated to help enforce the BWI Airport Noise Zone
Regulations. These regulations establish a "noise
zone" around BWI Airport. In this zone new
land development is prohibited if it is incompati-
ble with airport noise levels. The Board is autho-
rized and empowered to hear, decide, and grant
specific variances from airport zoning regulations
in cases of practical difficulty or unnecessary
hardship.
The Board was originally created by Chapter
450, Acts of 1968. Its membership was altered
and reconstituted by Chapter 443, Acts of 1976,
and Chapter 143, Acts of 1982. The Board con-
sists of ten members appointed by the Governor
with the advice of the Secretary of Transportation
and the advice and consent of the Senate. Three
members of the Board must be Anne Arundel
County residents. Three must reside in Baltimore
County and two in Howard County. Two mem-
bers, including the chairperson, must be residents
of other counties. Members serve four-year terms.
The Governor designates the chairperson (Code
Transportation Article, sec. 5-506).

The Maryland Transportation Commission,
created by Chapter 526, Acts of 1970, consists of
seventeen members. The seven regional members

of the State Roads Commission are ex officio
members, while the remaining ten members are
appointed by the Governor with the advice of the
Secretary. The appointed members serve three-
year terms. The Governor designates the
Chairperson.
The Commission meets at least monthly and is
charged with studying the entire transportation
system of the State. The Commission advises and
makes recommendations to the Secretary and Ad-
ministrators on matters concerning policy formu-
lation and program execution (Code Transporta-
tion Article, secs. 2-201 through 2-205).

The Board of Review of the Department of
Transportation consists of seven members
appointed for three-year terms by the Governor
with the advice of the Secretary and the advice
and consent of the Senate. At least four members
must represent the general public. The remaining
members are required to have knowledge and ex-
perience in one or more of the fields under the ju-
risdiction of the Department.
The Board is charged with hearing and deter-
mining appeals from certain decisions of the
Secretary or of any administration or agency
within the Department (Code Transportation Ar-
ticle, secs. 2-501 through 2-506).

The Maryland Transportation Authority, creat-
ed by Chapter 526, Acts of 1970, consists of the
Secretary as chairperson and six members who
are appointed by the Governor with the advice
and consent of the Senate for three-year terms.
