Commission; a representative of local a govern-
ment; and one member each from the Senate and
House of Delegates. The Council also includes
nine public members, of whom five are handi-
capped individuals and four represent the legal
profession, the public relations field, private agen-
cies, and an organization for parents of handi-
capped children. After the expiration of initial
terms of service, succeeding appointments are for
three-year terms. A member may not serve for
more than six years.

The State Advisory Council assists the Office
for the Coordination of Services to the Handi-
capped in the implementation and performance of
its responsibilities; reviews statewide activities fur
the handicapped; fosters coordination and sup-
port for programs for the handicapped; receives
and reviews reports and publications of existing
committees and commissions; studies ways of in-
creasing the use of facilities and services available
to the handicapped; and conducts open meetings
to provide direct communication by the handi-
capped with private and public organizations and
the general public in order to solicit statements
regarding the status of programs, services, needs,
desires, and opinions.

Authorizing legislation for the agency was ex-
tended to June 30, 1984, by Chapter 308, Acts of
1980.

Established by Chapter 528, Acts of 1980, this
Board is an independent seven-member group
appointed by the Governor. One member is nom-
inated by the Maryland Association of Counties,
one by the Maryland Municipal League, and one
by the Chamber of Commerce. Of the remaining
four members, two must be from the scientific
community, one of whom is a geologist, and two
must be members of the general public, one of
whom has a demonstrated record of involvement

in environmental matters. The Board represents
the various geographical regions of the State. No
two members may be from the same county. The
Maryland Environmental Service is staff agency
for the Board.

The Board is authorized to issue a Certificate
of Public Necessity, which exempts a particular
site and the design, construction, and operation
of the facilities on the site from the need for ap-
proval by any political subdivision. The subdivi-
sion in which a site is located has the right of in-
spection and the right to property taxes or
payment in lieu of taxes.

The Department of Health and Mental Hy-
giene retains full authority for the final approval
or disapproval of a facility through the permit
process. A Certificate is not required if approval
of the political subdivision can be obtained and
other requirements are met. A Certificate is
obtained by application to the Board.

The Act requires the Board to consider, though
not be limited to, two principal areas of concern
in issuing a certificate: first, the suitability of the
site with respect to community, environmental,
and economic impact; and second, statewide
needs for hazardous waste disposal and the abili-
ty of the proposed facility to contribute to a solu-
tion of the problem.

The purpose clause of the Act also itemizes
other factors that must be given due consider-
ation. These include: public health and safety; the
natural environment; geology and water supply;
cost; State revenues and employment; source re-
duction, resource recovery, incineration, and ex-
peditious disposal; safeguards once a facility is
closed; equitable geographic distribution; and lo-
cal land use preferences.
