MARYLAND MANUAL 49 It meets thirty days after any State election to tabulate the votes cast for each candidate from the certified statements of votes made by the city and county boards of canvassers. The Board declares who is elected and delivers a certificate of election to the Administrative Board. It issues the proclamation of election, keeps the records of the Board, and delivers a copy to the Governor who issues a commission to the persons elected (Code 1957, 1967 Repl. Vol., 1969 Supp., Art. 33, sees. 18-1,18-2). BOARD OF ETHICS (members not yet appointed) The Board of Ethics was established by the Governor in 1969 by executive order to advise on individual cases in which State employees might have conflicts of interest and to forbid officials to accept gifts or to use their positions for private gain. The Board consists of seven members appointed by the Governor for four years from the general public who are not subject to the Code of Ethics. The Governor desig- nates the Chairman. The Board may appoint an Executive Secretary. The Board has the power to recommend such orders, rules, regula- tions and changes to the Code of Ethics. The Board also has the power to render advisory opinions to officers and employees of the State or any of its agencies with respect to the applicability of the Code of Ethics. The Board investigates alleged violations of the Code and makes recommendations as to the necessary action to be taken. The same Executive Order also established the Code of Ethics for all executive branch officers and employees in areas of possible con- flicts between private interests and official duties as State employees (Code 1957, 1968 Supp., Art. 41, sec. 14). The Constitution requires the Board to meet on the first Wednesday of January, April, July and October in Annapolis and more often when necessary. The Board exercises such powers and duties as are prescribed in the Constitution or delegated to it from time to time by the General Assembly. The Board supervises the expenditures of all sums appropriated through State loans authorized by the General Assembly. The Board also super- vises the expenditures of all general and other funds appropriated for capital improvements except those appropriated for State roads, bridges, and highways; ana it approves the contracts for such ex- penditures after review by the Secretary, Department of Budget and Fiscal Planning, or the Director of the Department of Public Improvements, as the case may be. The Board approves every new lease or renewal for land, buildings, or office space before such con- tracts are executed by any department, board, commission, State officer, or institution of the State. It may also designate the location of any State agency, after review by the Secretary, Department of Budget and Fiscal Planning. |
