Advisory Board for Defective Delinquents

Chapter 629 of the Acts of 1961 also provided for the establish-
ment of the Advisory Board for Defective Delinquents. This Board
consists of the Professor of Psychiatry in the University of Maryland
Medical School, or someone designated by him; the Professor of
Psychiatry in The Johns Hopkins Medical School, or someone desig-
nated by him; one sociologist from the University of Maryland and
one sociologist from The Johns Hopkins University, each to be desig-
nated by the president of the respective institution; the Professor
of Constitutional Law at the University of Maryland School of Law;
the Director of the Department of Parole and Probation; and two
members of the Maryland Bar, who have had at least five years' ex-
perience in the trial of criminal and civil cases, who are appointed
by the Governor for five-year terms. The Board elects its own Chair-
man and Secretary and confers with the staff in regard to the psy-
chiatric, psychological and legal ramifications of Article 31B of the
Code in relation to the patients in custody of Patuxent Institution.

The Institutional Board of Review, also created by Chapter 629,
Acts of 1961, consists of the Director and the Associate Directors
of Patuxent Institution, the Professor of the University of Mary-
land School of Law who is the member of the Advisory Board, the
member of the Maryland Bar, who has served longer on the Advisory
Board, and a sociologist appointed by the Board of Patuxent Institu-
tion from the faculty of an accredited institution of higher education
in Maryland.
The Institutional Board of Review reviews and thoroughly reex-
amines every person held in custodial care as a defective delinquent,
not less frequently than once in every calendar year. Such review
and reexamination determines whether such persons shall remain
classified as a defective delinquent. The Board makes recommenda-
tions in writing for the future status and treatment of each person
so reviewed and reexamined.
