within the limits of the town, and shall disperse them when
assembled, and shall punish by moderate correction, under such
rules and regulations as shall be prescribed by the commissioners,
all slaves found strolling about the streets at night or frequenting
the houses of other persons without the consent of their masters.

147. Any fine which may be imposed by any by-layr or regu-
lation passed, by said commissioners with the agreement and
consent of the voters of the town, shall be recoverable before a
justice of the peace of Worcester county.

TRESPASS.

148. If any person shall cut down, or cause to be cut down, or
induce any person to cut down, any timber of a size not less than
those commonly used for hoop-poles with intent to steal the samo,
or any part thereof, within the limits of said county, lie, his
aiders and abettors, having knowledge of such intent to steal,
shall be adjudged guilty of felony, and shall be sentenced to such
punishment as is or may be prescribed by law for feloniously
stealing goods or chattels to the value of one tree or trees which
shall be cut down as aforesaid, and of the injury thereby oc-
casioned.

149. Any person who shall advisedly and maliciously, with the
intent to injure the owner of any land, house or building in said
county, cut down any tree, or cut down, break, dig or pull up, or
in any manner destroy or injure, any growing grain, shrubs,
herbs, roots, vines or vegetables, or shall cut, break, pull off,
destroy or injure any part of any house or other building, or of
any wall or fence, or any ornament or other valuable article at-
tached to any house or other building, wall or fence, in said
county, shall, on conviction thereof, bo adjudged guilty of a mis-
demeanor, and shall be fined and imprisoned, or both, in the dis-
cretion of' the court before which he shall be tried and convicted.

WITNESSES.

150. Each witness residing in said county summoned to attend
the Circuit Court for said county shall be entitled to receive for
each day he shall attend as a -witness the sum of seventy-five cents,
and four cents a mile for every mile his place of residence may
be distant from the place of holding said court/to be computed
for every day he shall attend; but no witness shall be allowed
