within said town, shall, on the third Monday of March in each
year, at the court-house in said town, elect by ballot three judi-
cious and discreet persons residing in said town, or within five
miles thereof, commissioners in the place of those whose term
of office has expired.

34. The commissioners of said town, or the majority of them,
shall be judges of said election, and every commissioner, before
he shall proceed to open an election, shall make oath that he
will faithfully and impartially permit every person to vote at
such election who shall be qualified to vote, and that he will not
suffer any person to vote at said election who shall not in his
judgment be qualified to vote.

35. If any vacancy shall occur in the office of commissioners,
the remaining commissioners shall, after ten days' previous
notice thereof, hold an election to fill such vacancy during the
remainder of the term.

36. Every commissioner, before entering upon the duties of his
office, shall make oath before some justice of the peace that he
will diligently and faithfully, according to the best of his judg-
ment, perform the' duties of his office, and a certificate of such
qualification shall be returned by the justice to the commissioners
and recorded among their proceedings.

37. The said Commissioners, or a majority of them, shall meet
at the court-house in said town, or at such other public place
therein as shall be previously notified, on the first Monday
in April, and statedly on the first Monday in every third
month thereafter, or at such other times as they may deem
necessary.

38. They may appoint a clerk, who shall keep minutes of
their proceedings in well bound books to bo provided by them
for that purpose, and also regular accounts in a ledger of all
persons indebted to the commissioners, except those who shall
become indebted for town taxes, and the said books shall be
subject to the inspection and examination of all persons in-
terested therein.

39. They may make such ordinances as they may deem neces-
sary and beneficial to the said town; may cause all nuisances
to be abated, and all obstructions in the streets, lanes and alleys
