joint owner shall be liable for all the expenses thereof, to be
recovered as prescribed in the last preceding section.

53. The county commissioners of said county shall appoint
three discreet persons for each election district therein to act as
judges of the damages sustained by the possessors of lands and
owners of stock trespassed upon or injured.

54. The judges so appointed, before they shall proceed to act,
shall make oath before a justice of the peace for the county that,
in the event of being called upon to act under the provisions of
the preceding section, they will view the case impartially, without
favor or affection to either party, and make their award accord-
ingly, and they shall return a certificate of their qualification to
the clerk of the Circuit Court for said county within twenty days
after their qualification, to be filed therein.

55. Upon complaint made to said judges by any person, of
depredation committed by stock upon his premises, they shall
repair to and view the same, and if they shall be of opinion that
the party complaining has sufficient fences around his enclosure
to keep off stock, they shall award him such damages (including
one dollar each for each day or part of a day they may be em'
ployed for their attendance) as they think just.

56. And in like manner in case of stock being injured by per-
sons upon whose lands they may trespass, they shall, if they
think the fences around the same insufficient to keep off stock,
award damages (including their per diem as directed in the pre-
ceding section) for the injury to the stock.

57. Any award made by the said judges may be collected a»
other debts, before any tribunal having jurisdiction over such
sum as may be awarded.

FISH.

58. No person shall stake out or fix any seine across the river
Wicomico in Somerset county, or aid or assist therein, by which
fish may be obstructed in going up or coming down said river.

59. Any person offending against the provisions of the pre-
ceding section shall, for every offence, forfeit the sum of twenty
dollars, to be recovered by action or indictment in the Circuit
Court of the county where the offender shall be apprehended
