104. If the owner, possessor or occupier of such mill shall
neglect to make such dam and bridges in the manner directed
in the preceding section, and to keep the same in good repair,
he shall, on conviction thereof, forfeit and pay a sum not ex-
ceeding fifty dollars, to be paid to and accounted for by the
supervisor of the district in which such mill may be situated.
10&. The supervisors of roads in said county, may cut an open-
ing in any bank erected, or to be erected, alongside of the public
road in any place where the water will be likely to lie, so that
said water may pass off.
106. Any person in said county may erect and keep on the
public roads therein as many gates as he may deem necessary.
lOf. Any person erecting or keeping a gate on any of said
roads, shall have the same hung on good and substantial iron
hingea; and shall keep the same, and that part of the road
immediately around the same, in good repair.
108. He shall pay annually a tax of one dollar for each gate
kept on said roads.
109. The supervisors of roads, when they render their accounts
to the county commissioners for settlement, shall accompany the
same with a list, under oath, of the number of gates on the public
roads in their respective districts, and the names of the persons
to whom they belong; and when a list of gates has been so
rendered, the person to whom they shall belong shall stand
charged annually on the books of the collectors with the tax
thereon, until they shall satisfy the county commissioners of
their abatement or removal.
110. A supervisor having once returned a list of gates under
the preceding section, shall thereafter only return annually,
such gate or gates as may be subsequently put on said roads.
111. The county commissioners, when making out the lists of
taxes, shall enter to each owner of a gate or gates on the public
roads, the amount of their gate tax in addition to their regular
county tax, and it shall be* collected by the collector of the
county taxes, at the same time and in the same manner.
