the possession or use of such person at the time of the seizure,
together with the boat or vessel, and all things on board or
belonging to the same, employed to convey the said person or
persons to any of the aforesaid -waters for the purpose of making
use of any or all the above enumerated articles in the manner
aforesaid; all which said articles, boat or vessel, and all other
property seized and taken by virtue of this section, shall be
condemned and sold and the proceeds distributed as hereafter
directed.

205. Any sheriff, constable, or commissioned militia officer in
said county who shall be satisfied, either upon his own view or
from information received from any other person, whether on
oath or not, that any person or persons have violated any of the
provisions Of the preceding section, may arrest and take into his
custody the person or persons so offending, and the boatmen
found on board belonging to the boat or vessel employed to con-
vey any or all of such offenders to said county for the purpose
of shooting at or killing wild ducks, or wild fowl of any descrip-
tion whatever, contrary to the provisions of the aforesaid sec-
tion; and he shall take into his possession the said boat or
vessel, and all the appurtenances belonging to the same, and all
the articles and other property enumerated in the aforesaid
section.

206. The officer making such arrest and seizure shall take the
person or persons arrested before a justice of the peace for said
county, representing to such justice the breach of law committed,
and the justice shall docket a case in the name of the State
against each person in the custody of the said officer, and imme-
diately have summoned before him the witness or witnesses in
the case or cases, and shall examine them on oath, and if he
shall think the charge groundless, he shall immediately dismiss
the same at the cost of the county.

207. Any person who aided the officer in making the arrest
and seizure shall be a competent witness against the parties
charged, and the finding decoy ducks, sink boats, sneak boats or
floats, on board of the said boat or vessel employed as aforesaid,
or in the possession or use of the party charged, shall be con-
sidered as prima facie evidence of guilt.

208. If the justice shall be of opinion that any wild ducks or
other wild fowl have been shot at or killed in violation of the
