670 KENT COUNTY. .[ART. 14.

legal obligation to sell the property therein mentioned, and to
make the plaintiff's claim; and his official bond shall be liable to
the plaintiff in any such execution for non-performance of duty,
in the same manner as it is where such writ may be renewed
every forty days; but nothing herein shall be construed to affect
the rights of any representative or security of a deceased con-
stable, to have new process issued.

LANDINGS.

117. The proceedings for the establishment, making, altering
or closing any public landing in Kent county, shall be in all
respects the same prescribed by the laws of this State for the
opening, altering or closing roads.

118. No lot or piece of ground condemned for a public landing
in Kent county shall exceed one acre of land in extent.

MILLINGTON.

119. The white male citizens of Millington in Kent county,
including therein the place formerly called Sandtown, in Queen
Anne's county, residing and having families therein, shall, on
the second Saturday of March annually, between the hours of
two and five o'clock, p. M., elect five inhabitants of said town as
commissioners, for one year from the first day of April next
ensuing, and the said commissioners, by the name of " The Com-
missioners of Millington," are a body politic, with power to sue
and be sued, and to have and use a common seal and alter the
same at pleasure.

120. The said commissioners shall give at least ten days' pub-
lic notice of said election, and any justice of the peace may pre-
side thereat, and if no justice be present at the time of holding
said election, the commissioners, or a majority of them, may hold
the same.

121. If any thing shall prevent the said election from being
held on the day appointed, the commissioners, or a majority of
them, shall appoint another day for holding the same, and shall
give notice thereof at least five days previous thereto; and the
commissioners shall fill up all vacancies in their own body which
may happen within*the year.
