cattle, sheep and hogs,) with the intent to sell the same again
within the space of twenty days, shall forfeit and pay the sum
of five dollars, and the clerk of the market shall prosecute such
offender.

66. The market house in said town and the grounds thereunto
appertaining shall be vested in said commissioners, who may keep
the same in repair and make such rules for the regulation of the
market there to be held, and the time of holding the same, as
they may deem proper, not inconsistent with the law.

67. If any person shall put any horse, mare or gelding into or
under the market house in said town, on any pretence whatso-
ever, he shall forfeit fifty cents.

68. The said commissioners shall annually, in the month of
June, appoint a clerk of the market house in said town, and if
the person so appointed shall die, resign or refuse to act, or be
rendered incapable of acting, the said commissioners shall appoint
some person in his place.

69. Every clerk so appointed shall, before he acts as such,
take the following oath before some justice of the peace of Kent
county: " I, A. B., do swear that I will diligently and faithfully,
according to the best of my skill and judgment, execute and
perferm the duties of clerk of said market, without favor, affection
or partiality, and that I will not, directly or indirectly, receive
any fee .or reward for doing the duties of clerk as aforesaid except
what is allowed by law."

70. The said clerk shall take charge of the market and market
house in said town, and inspect the provisions brought thereto
for sale, and if any shall be found unsound or unwholesome, shall
destroy the same; and shall try and adjust the weights and
measures used at the said market by the county standards, and
shall seize the same when false or untrue, and sell the same to
the highest bidder, and apply the proceeds as fines are herein-
after directed to be applied.

71. He shall try by standard the weight of butter, and such
articles of provision as are generally brought to market made
up at a stated weight, and if they shall be found deficient in
weight, shall seize and sell the same to the highest bidder.
