with three buckets; and all above fifteen nundred shall be fur-
nished with four buckets.

53. If a house be rented, and the owner thereof shall neglect
to furnish the same with a bucket or buckets, the tenant may
procure the same at the expense of the owner and deduct the
price from his rent.

54. The bailiff shall make duo inquiry at every house, and
report all persons who may fail to have buckets as hereinbefore
directed to the commissioners, and each delinquent shall forfeit
the snm of three dollars for every bucket not furnished, to be
recovered before any justice of the peace in Kent county, in the
name. of the commissioners, and to be applied to the purchase of
buckets; Provided, that proof be given to the justice that the
party charged had been reasonably requested to exhibit the
buckets to the bailiff.

55. The said commissioners may, if in their judgment the pub-
lic convenience will not be affected thereby, allow encroachments
upon the public streets and alleys in said town by buildings,
porches, steps and fencing.

56. The money annually levied by the county commissioners
of Kent county for repairing the streets, lanes and alleys of said
town, shall be paid to said commissioners or their order, and
shall be expended by them for that purpose, and they shall ap-
point, before the first day of May annually, a supervisor of said
streets and alleys, and of the public road between said town and
Whaland's mill, and between said town and James Boone's (for-
merly Samuel Thomas') gate, and the county commissioners shall
not levy the said sum of one hundred dollars for their use until
they are satisfied that such appointment has been made and
accepted.

57. The said supervisor shall be liable to presentment and indict-
ment for neglect of duty, and may be fined in the discretion of
the court, and the want of funds shall be no defence on such pre-
sentment or indictment, unless the said supervisor shall, within
ten days after the funds are exhausted, report the fact to the
clerk of the Circuit Court of Kent county.

58. The said commissioners shall furnish to the said supervisor
ample funds to mend and repair and keep in good order the
