241. They shall, as soon as convenient, take all persons whom
they have apprehended before some justice of the peace for the
county for examination, and if upon such investigation and
inquiry the justice shall be of opinion that such person has run
away from the service of his master, or has illegally emigrated to
this State, or in any manner violated the law, he shall commit
him to the county jail to be dealt with according to law; but if
any person so apprehended shall, on inquiry, be found guilty of
a misdemeanor, only cognizable by a justice of the peace, he
shall be dealt with accordingly.
242. They shall, if they have reason to suspect that any run-
away negro slave is concealed or harbored in any dwelling or
out-house of any negro within their search, demand admittance
of the owner or occupant of such house; and if the owner or occu*
pant shall refuse such entry, they may use all necessary force
to effect the same, and in any suit brought by any owner or occu-
pant for any entry made in pursuance of this section, the defend-
ant may, on the general issue, give the special matter in evidence.
243. If any person named in such requisition or patrol, on
being duly notified, shall refuse or neglect to obey the sum*
mons, he shall be subject to a fine not exceeding five dollars
nor less than fifty cents, to be recovered by summons in the
name of the State, and paid to the county commissioners for the
use of the county.
