ment until discharged by due course of law, or by payment of
the fine, forfeiture and costs.

212. The burgess and commissioners shall at the time of com-
mitment, and weekly thereafter during the confinement of the
person so committed, pay to the said sheriff the sum of one
dollar for the support of the person so committed, and to be
repaid to them before the party shall be discharged; and on
failure of the burgess and commissioners to make such payment
to the sheriff at the end of any one week, the sheriff shall dis-
charge the party upon payment of all moneys previously ad-
vanced for his support.

MIDDLETOWN.

213. The citizens of Middletown, Keller's Addition to Middle-
town, Grove's Addition to Middletown, and Wise's Addition to
Middletown, in Frederick county, are a body corporate by the name
of The Burgess and Commissioners of Middletown, and by that
name may sue and be sued, and may have and use a common
seal.

214. The bounds of said town shall be as described in the plat
thereof, on record in the office of the clerk of the Circuit Court
for Frederick county.

215. The free white male citizens of Middletown, of the age
of twenty-one years and upwards, who shall have resided in said
town for six months next preceding the election, shall, on the
first Mondav in April, annually, elect, by ballot, a burgess and five
commissioners, who shall have resided within the said town
twelve months next preceding the election.

216. All elections shall be held and conducted as shall from
time to time be directed by the by-laws of the corporation, not
inconsistent with this charter.

217. The burgess shall qualify as directed by section 6 of
article sixty-eight of the code; the commissioners and all other
officers of said corporation, before entering upon the duties of their
respective offices, shall, before the burgess, take and subscribe the
following oath: " I do solemnly swear that I will faithfully exe-
cute the office of ---- to the best of my knowledge and ability,
without favor, affection or partiality, so help me God."
