580 FREDERICK COUNTY. [ART. 11.

206. If any owner or tenant of any house or lot, or part of a
lot, or the person having charge thereof, shall refuse or neglect
to level, pave or repair the footway in front of the same, accord-
ing to the ordinance of the burgess and commissioners, the com-
missioners, or a majority of them, may contract with some
person on reasonable terms to level, pave or repair the same,
and may collect the expense thereof, with costs, by distress on
such property.

207. The burgess shall be treasurer of the corporation, and
shay give bond to the corporation, with security, to be approved
by the commissioners or a majority of them, in such penalty as
they shall prescribe, conditioned for the faithful discharge of his
duty as treasurer, and he shall receive and pay away all moneys
that he shall be directed to receive and pay away by the ordi-
nances of the commissioners.

208. He shall see that all ordinances are duly and faithfully
executed; shall in virtue of his office have and exercise within.
the said town all the jurisdiction and powers of a justice of the
peace, except as to the recovery of small debts, and shall report
annually to the commissioners during the first two days of their
session the general state of the town, with an accurate account
of the money received and expended, to be published for the
information of the people.

209. All fines and forfeitures under the ordinances of the
corporation may be recovered as small debts before the burgess
or a justice of the peace, and the burgess shall be entitled to the
same fees as a justice of the peace for similar services.

210. All such fines shall be recovered in the name of the bur-
gess and commissioners of Mechanicstown, and shall be for the
use of the corporation; but no fine or forfeiture shall exceed the
sum of twenty dollars for any one offence.

211. The sheriff of Frederick county shall receive, and safe
'keep in the jail of said county, all persons who shall be com-
mitted thereto by the burgess of said town, or any justice of the
peacfe of said county, for violation of any of the ordinances of the
burgess and commissioners of said town, or for the non payment
of any fine or forfeiture which may be imposed by the said bur-
gess, or any justice of the peace of said county, for the violation
of any of said ordinances, according to the tenor of said commit-
