121. They may, with the consent of five-sixths of the property
holders on any street or part of a street, levy and collect from
the property holders on such street or part of a street a sufficient
tax for the purpose of extending the Baltimore and Ohio Bail
Road from the depot to any such street, and through the same
or any part thereof; and any tax so levied shall be apportioned
among the property holders on said street according to the
number of feet fronting the line of the rail road thus extended,
and on no other property holders on said street.

122. They may lay and construct and keep in repair a single
or double track of rails from Market street, where it intersects
All Saints street, though the last named street to and through
the depot ground of the Baltimore and Ohio Kail Road Company
near said city so as to intersect said rail road, and may pay the
expense thereof out of the revenues of the city; but the said rail
road company may enclose, regulate and use the said depot,
except so far as not to prevent or interfere with the proper use
of the said rail road thus extended.

123. All persons of seventy years of age residing in said city,
shall bo exempt from all duty in relation to fire company meet-
ings and fires, and shall not be required by the said corporation ^
or the fire companies of said city to attend any such meetings, or
to be present and assisting, and shall not be fined for neglect to
attend.

124. The rights, property, franchises and privileges granted
by this State to the president and directors of the Frederick
water company, are vested in the corporation of Frederick, and
the said corporation may introduce into the said city any body
of water that may be necessary for a full supply of said city,
and may convey the same in such manner and direction as the
said corporation may think proper.

125. The said corporation may purchase and hold all such
lands, tenements, goods and chattels as may be necessary to
carry into effect the provisions of the preceding section, and
may grant and alien the same; may make and lay conduits or
tunnels for the conveyance of said water under and along the
public highways, streets, lanes, alleys and side pavements, or
any of them, of the county or city of Frederick, for the purpose
of conveying and distributing said water, and may from time to
time renew and repair the same, leaving at the same time a
