same, and deliver a copy thereof, with the amount of tax on each
annexed, to the collector of the county taxes, to be by him col-
lected and accounted for as other taxes.

179. 4-ny person who shall neglect or refuse to make such re-
turn, and shall continue to keep up such gate, shall forfeit all
•protection under and right to the privileges secured by this
law.

180. If any person shall cut down, destroy, wilfully leave fixed
open or remove any gate on any such road, he shall, upon con-
viction thereof before a justice of the peace, forfeit and pay to the
owner thereof a sum not less than one nor exceeding ten dollars
for every offence, to be recovered as small debts are out of
court.

181. If any slave shall cut down, destroy, injure or wilfully
leave fixed open any gate on any public road erected and returned
as aforesaid, he shall, on conviction before a justice of the peace,
be punished by whipping on his bare back not exceeding, in the
discretion of the justice, ten lashes; but the master of such slave,
or any other person in his behalf, may redeem such slave from
.said punishment by payment of the fine imposed by the last pre-
ceding section.

182. No person, free or slave, shall be punished under this law
in any case where such gate shall be found carelessly standing
open, not hung upon good iron hinges, or otherwise in bad order
and repair.

183. The owner of any land in district number six in said
county near the store house of Samuel Dnnnoek may erect a gate
on the public road thereby, and shall keep the same in proper
condition under the direction of the supervisor of said road, and
if the gate be out of repair, the supervisor shall notify him of the
fact, and if he fail to repair said gate within twenty days after
such notice, the privilege hereby conferred shall be forfeited and
the overseer shall remove such gate.

184. The county commissioners of Dorchester county shall
levy a tax of one dollar and fifty cents for each year daid gate
shall be kept upon said road, to be collected from the ownwof
said lands.
