25. They may, out of the money so levied, keep any number
of out-pensioners they may think proper; Provided, the amount
paid therefor in any one year shall not exceed the sum of seven
hundred dollars, and that no out-pension shall be allowed to any
person who is not a fit subject to be received into the alms-
house.
26. They shall, under the penalty of fifty dollars each, make
out and render to the county commissioners at their first meet-
ing in May in each year, a statement of their accounts and
expenditures, with the necessary vouchers therefor; which ac-
counts shall be examined, settled and passed by the commis-
sioners at their discretion.
27. Each trustee shall be entitled to one dollar and twenty-
five cents for each day he shall serve in the discharge of his
duties, and six cents a mile for each mile his residence shall be
distant from the alms-house.
28. All sheriffs, constables and other officers, shall aid and
assist the trustees of the poor in Dorchester county, and all
officers and servants by them appointed, in the discharge of
their respective duties.
29. If any person shall be sued or prosecuted for any thing
done in the execution and performance of any duty imposed by
this law, or any matter or thing herein contained, he may plead
the general issue, and give the special matter in evidence in his
defence, and if upon trial, verdict shall be given for the defend-
ant, or if the plaintiff be non suit or discontinue, the defendant
shall recover treble costs, and if the plaintiff is unable to pay
the same, they shall be paid by the attorney who brought the
suit, unless the plaintiff shall give security for the costs, to be
approved by the court.
STATE'S ATTORNEY.
30. In all criminal cases which may be tried before a jury
in the Circuit Court for Dorchester county, the judge of said
court may, in addition to the sum allowed by law, allow to the
State's Attorney for said county such compensation, not exceed-
ing the sum of twenty dollars for any one case, as the said judge
may think right and proper, to be levied and collected from
Dorchester county.
