and shall continue to use or keep up such gate or gates, on or be-
fore the first day of May in every year as aforesaid, such person
shall forfeit all right to keep such gates.

167. All moneys collected by the collector of said county as
taxes upon gates shall be paid over to and applied by the
county commissioners of said county towards defraying the
county charges.

168. In all cases where a tenant shall reside on lands through
which public roads may pass, and shall keep gates thereon,
it shall be lawful for such tenant to return such gates in the
manner before prescribed, and to pay the tax thereon; and he
shall be allowed the same by his landlord in his rent upon
producing the collector's receipt, showing that he has paid the

same.

169. If any slave shall cut down, destroy, injure, or wilfully
leave open any gate upon the public roads which shall have been
returned in the manner prescribed, such slave shall be punished
for every such offence, on conviction before a justice of the
peace, by whipping on his bare back, in the discretion of the
said justice, not exceeding for each offence the number of ten
lashes; but the master of such slave, or any other person in
his behalf, may redeem said slave from said punishment by
the payment of the fine to the owner of such gate imposed
upon free persons for like offences.

170. No free citizen shall be fined or slave punished under the
provisions herein relating to gates, in any case where such gates
shall be found carelessly standing open, not hung upon good iron
hinges, or otherwise in bad order or repair.

171. The provisions of the preceding sections relating to and
authorizing gates on the public roads in Caroline county, shall
not apply to the third election district in said county, in which
district no gate upon a public road shall be allowed, and any
person erecting a gate upon a public road in said district
shall be subject to a fine of five dollars for each offence, to be
recovered before any justice of the peace for said county as
small debts are, and applied to the use of the roads in said
district.
