394 CAROLINE COUNTY. [ART. 6.

lect to perform any reasonable duty enjoined upon him by the
supervisor, he shall be fined not exceeding sixty cents, to be re-
covered at the instance of the supervisor in the name -of the
State, before any justice of the peace of the county, and to be
appropriated in the employ of other hands for the public roads.

161. If any person shall alter, change, obstruct or encroach
upon any road in Caroline county, or cut down, destroy, or pur-
posely injure any bridge or causeway, he shall, on conviction
thereof in the Circuit Court, be fined in the discretion of the
court in a sum not exceeding fifty dollars, to be applied to thn
use of the county.

162. It shall be lawful for any of the citizens of Caroline
county to keep on the public roads in said county all such gates
as are now erected on the public roads for their own private use
and convenience, upon the express conditions following: every
owner of a gate kept on the public roads shall have his gate
hung on good and sufficient iron hinges, and shall keep the same
and that part of the said road which they occupy in good order
and repair, so as to impede as little as possible persons travelling
with carriages of pleasure or burthen.

163. If any person shall cut down, destroy, wilfully leave open
or remove any of the said gates, they shall, upon conviction
thereof before a justice of the peace, forfeit and pay to the owner
of such gate a sum not less than one nor exceeding ten dollars
for every such offence, to be recovered as small debts.

164. On all gates authorized to be kept upon the public roads,
the owner shall pay annually a tax of one dollar for each gate.

165. The owner of all such gates is required to transmit, on or
before the first day of May annually, to the clerk of the county
commissioners of said county, an account of the number by him
owned and kept on the public roads, in writing under his hand
and seal, and such clerk shall keep a list of the same, and shall
deliver a copy thereof, with the amount of tax on each annexed,
to the collector of the county taxes, to be by him collected ae
other taxes.

166. If any person shall neglect or refuse to give in a state-
ment of the number of gates by him owned and kept on the
public roads to the clerk of the county commissioners aforesaid,
