354 CALVERT COUNTY. [ART. 5.

dence in his defence; and if, upon trial, verdict shall be given for
the defendant, or if the plaintiff shall be non suit or discontinue,
the defendant shall recover treble costs, and if the plaintiff shall
be unable to satisfy the same, they shall be paid by the attorney
"who brought the suit, unless the plaintiff shall give security for
the costs, to be approved by the court.

21. The said trustees may pay any clerk they may appoint the
earn. of sixty dollars per annum for his services.

CIRCUIT COCKT.

22. There shall be two regular common-law terms of the Cir-
cuit Court for Calvert county, at Prince Frederick, commencing
on the second Monday in May, and on the second Monday in
October, in each year.

28. The 'judge of the Circuit Court for Calvert county, in his
discretion, may appoint intermediate terms for the transaction
of equity business, to which equity process shall be returnable, as
well as to the stated terms of the court.

COUNTY COMMISSIONERS.

24. There shall be three county commissioners for Calvert
county.

25. The compensation of each county commissioner shall be
two dollars for each day's attendance; and if he reside one mile
or more from the county town, he shall receive, in addition to his
per diem, mileage at the rate of six and a quarter cents per mile
for the distance necessarily travelled from his residence to the
county town, on each day's attendance.

26. The salary of the clerk of the county commissioners shall
be two hundred dollars per annum.

27. The said clerk, before he enters upon the duties of his
office, shall give bond to the State of Maryland, to be approved
by the county commissioners, in the penalty of one thousand
dollars, conditioned for the faithful performance of the duties of
his office, and the said bond shall be recorded in the office of the
clerk of the Circuit Court for Calvert county.
