123. No toll shall be charged to any person passing or re-
passing from one part of his farm to another, or to or from
mill, or to or from any place of public worship, funeral, mili-
tia training, elections, or to any student or child going to or
returning from school, or to persons going to and returning
from courts; nor shall any toll be charged or collected for the
passage of any wagon or carriage, laden with the property of
the United States, or any cannon or military stores belonging
to the United Sta'tes, or to any of the States composing this
Union.
124. If any person subject to the payment of tolls, shall
pass through any private gate or bars or along or over any
private way, or other ground, near to or adjoining any toll-
gate, or over any other ground, with the intent to evade the
payment of toll for passing such gate, or practise any other
fraudulent device, or misrepresent the distance used or travelled,
with the intent that the payment of such toll may be evaded
or lessened, he shall for every offence forfeit the sum of five
dollars.
125. The tolls upon that part of the road lying between
Frostburg and Cumberland, shall be reduced one-third from
the rates charged upon wagons, carts, or other vehicles not
laden with' coal.
126. The owners of every passenger or mail coach or stage,
passing the gates on said road, shall pay the sum of four cents
for every passenger carried in the same, for every space of ten
miles on the road, and so in proportion for every greater or less
distance, which shall be taken and received in lieu of all other
toll on said coach or stage.
127. The proprietors of such coaches or stages, or their agents,
shall, on the first Monday of every month, furnish on oath to
the superintendent a list of the passengers transported over said
road in their respective coaches for the month next preceding,
and upon their failure to do so, the gate keeper at gate number
one shall demand and collect from the proprietor so failing one
dollar for each stage or coach passing over said road its entire
length.
128. The superintendent shall sue the proprietors of any stage
or coach refusing to pay the toll prescribed in section 126 of this
