shall be given of any application for the passage of such ordi-
nance, in at least two of the daily newspapers in the said city.

839. Before any commissioners appointed by any ordinance of
said corporation under the two preceding sections shall proceed to
the performance of their duty, they shall give notice in at least
two of the daily newspapers in the city of Baltimore of the object
of the ordinance under which they propose to act, at least thirty
days before the time of their first meeting to execute the same.

840. The mayor and city council may fix and establish the
permanent grade of all the streets, lanes and alleys marked,
located and laid out upon the plan of said city, whenever applica-
tion shall be made therefor by persons owning more than one-half
of the ground fronting on the streets, lanes or alleys respectively
required to be graded, although such streets, lanes or alleys shall
not have been opened, nor an application for that purpose made.

841. They may provide from time to time by general ordinance
for fixing and establishing such grades, through the commissioners
or other persons to be appointed or employed, as such ordinances
may direct, and on application to such commissioners or persons,
and notice of such application as may by the said ordinance be
prescribed; and the expenses of such grading shall be paid as
such ordinance shall direct.

842. "Where real estate within the said city has been or may be
divided according to law, among heirs, legatees, joint tenants or
tenants in common, entitled to the same, and such division calls
for any of the streets, lanes or alleys, or any part or parts thereof,
surveyed and laid off under the law of 1817, or reserves any of
the said streets, lanes or alleys, or any part or parts thereof, as
open, and divides such estate with reference thereto, the mayor
and city council may, on application of one or more persons inte-
rested in the ground to be taken on such application, adopt and.
sanction by ordinance the principle under which such division
was had, and open any of the said streets, lanes or alleys, or any
parts thereof, in the said division reserved or recognized; Pro-
vided, at least one week's notice in the newspapers of said city
(the cost of the advertisement to be paid by the applicants) be
given of such application before any such ordinance shall pass.

843. All, the streets, lanes or alleys opened in the manner
directed in the last preceding section shall be public highways,
