may require, and the sentence of any such courts martial, when
approved by the proper officer, to be enforced agreeably to the
provisions of the existing laws.
CITY GUARD.
771. The persons composing the military company known
as the Baltimore City Guard are a corporation, by the name of
" The Baltimore City Guard," and by that name have perpetual
succession, may sue and be sued, and may have and use a com-
mon seal; may take, hold and possess real, personal and mixed
property not exceeding in value fifty thousand dollars, by gift,
grant, purchase, bequest or devise, and may sell, transfer, lease
and convey the same, and may establish such by-laws, rules and
regulations for conducting the affairs of the corporation not
contrary to law, as they may think necessary and proper.
772. The said organization shall have power to form a batta-
lion, to be composed of not less than five companies, which com-
panies shall be designated by the numbers one, two, three, four
and five, and shall consist respectively of not less than thirty
men nor more than sixty-four men, rank and file.
773. The members of each company shall have power to elect
one captain, a first lieutenant, and the commanding officer of
the battalion shall appoint a second and third lieutenants, when
in his judgment such additional officers shall be required.
774. When two companies are duly organized, they shall have
power to elect a major, and when four companies shall be so
formed they shall have power to elect a lieutenant colonel.
775. All of the above named officers shall be elected, commis-
sioned and qualified as officers of like grades in the volunteer
militia of the State, and at any meeting or on any parade of
said battalion, the senior officer present shall have command or
preside.
776. The commander of said battalion shall be entitled to have
a staff, consisting of an adjutant, a quarter master, a paymaster,
and a surgeon, who shall rank as officers of the like grade in the
"United States army; and shall be duly commissioned by the
Governor.
