tried by this court according to law;" and the president shall
take the same oath, to be administered by any member of the
court.

696. Any officer required to attend as a member of a division,
brigade, regimental or company court martial, or any other
court as established under the provisions of this law, who shall
refuse or neglect to attend at the time and place appointed,
shall be fined a sum not exceeding one hundred dollars, in the
discretion of said court, unless he can give a reasonable excuse
for non-attendance; and any non-commissioned officer or private
required to attend as a member of any such court who shall
refuse or neglect to attend at the time and place appointed,
shall be fined a sum not exceeding five dollars, in the discretion
of said court, unless he shall give a reasonable excuse for auch
non-attendance; and if the members appointed on said court do
not attend so as to form a quorum, each of the absentees shall be
fined a sum not exceeding one hundred dollars, in the discretion
of such court martial as the case may require; which said fines
shall be returned for collection to the officer ordering said court,
except in cases of division courts martial, when the fines shall be
returned to the commanding officers of the brigade to which the
offender belongs, in the same manner, under the like penalty,
and within the time herein directed for the return of other fines.

697. The president of each court martial, or other court
created under the provisions of this law, shall, within three days
after the passing of any sentence of such court, return such
sentence in writing, certified by said president to be the correct
sentence of the court, to the commanding officer of the division,
brigade, regiment or company ordering the same; and in the
returns made by the courts of appeal of absentees from parade,
it shall be distinctly written opposite to the respective names of
those whose fines have been remitted, and such as are not thus
exempted shall be held liable for the same.

698. The commanding officer of the third division and the first
light division of Maryland volunteers shall, from time to time, as
may be necessary, appoint some suitable person to collect all
fines imposed on the officers, non-commissioned officers, musicians
or privates of said divisions.

699. The said collector, before entering upon the duties of his
office, shall give bond with security to the State of Maryland in
