privates and musicians as absentees from parade, shall consist of
not less than three nor more than five members, one-third of
whom at least shall be privates.

678. The commanding officer of the regiment shall, within six
days after each parade, notify the members of said court of their
appointment, and transmit to the president thereof a list of ab-
sentees from said parade.

679. The court of appeals shall be held on the second Monday
after each parade, at the time and place which shall have been
previously established by the officer ordering the same.

680. If the commanding officer of a regiment shall refuse or
neglect to summon said court of appeal within the time pre-
scribed in the preceding section, or to notify the members or
transmit to the president thereof a list of absentees as herein
required, he shall be fined not exceeding fifty dollars, in the dis-
cretion of such court martial as the case may require.

681. The commanding officer of each brigade shall, within
twenty days after the last parade of the year, appoint the court
of appeal of his brigade, which shall have power to remit the
whole or part of such fine or fines as may have been incurred
by the general officers, regimental field officers and brigade and
regimental staff officers who were absent from said review and
parade, upon its appearing to said court of appeal that sickness
or some such sufficient excuse was the cause of such absence;

but business shall not be admitted as a cause of acquittal.

682. The courts of appeal to decide upon the remission of
fines incurred by the general officers and their respective staff
officers, the regimental officers and their respective staff officers,
as absentees from parade, shall consist of not less than three
nor more than. five members; two-thirds of whom at least shall
be field officers. •

683. The commanding officer of each brigade shall, within
twenty days after the last parade of the year, notify the mem-
bers of said court of their appointment, aa well as of the time
and place of holding said court, and transmit to the president
thereof a list of absentees from said review and parade; and it
shall be the duty of the brigade major of each brigade to notify
the said absentees of his brigade from said review and parade,
