480 OYSTERS. [ART. 71.
21. Low water mark shall for the purposes of this article be
considered the outer limit of the shore.
22. If any person in cleaning or trimming oysters or picking
them for market, shall throw the shells or oysters into any of
the waters of this State, he shall pay a fine of not less than five
nor more than twenty dollars, to be recovered before a justice
of the peace.
23. If any person shall take or catch oysters in Sinepuxent
Bay or any of the waters thereof, with scoops, drags or any
other instrument whatsoever, at any time between the thirtieth
day of April and first day of September in any year, he shall be
liable to the same penalty and forfeiture as if he had violated
the first section of this article, and shall be proceeded against
in the same manner.
24. No person shall catch any oysters in Little Choptank or
Hudson River in Dorchester county, or any of the creeks of said
river in said county, for the purpose of manuring land, nor shall
any person in Dorchester county purchase any oysters for the
purpose of manuring land, knowing they were caught in said
river or creeks, and any person so catching or purchasing, shall
be liable to a penalty of not less than ten nor more than fifty
dollars, to be recovered before a justice of the peace.
25. No person except citizens of Dorchester county shall take,
catch or carry away, between the first day of May and the first
day of October in any year, any oysters from any rock, oyster
bar, shoal or place of natural deposit or growth in said county,
for the purpose of burning them into lime, nor shall any citizens
of other counties at any time take and carry away oysters
found in the waters of said county, for the purpose of burning
them into lime, or bedding or planting them, and any person
violating the provisions of this section shall be liable to the
penalty and forfeiture imposed herein for violations of the first
section of this article, and to be proceeded against in the same
manner.
26. No person shall take, catch or carry away any oysters
from any cove or oyster bed in St. Jerome's or Point Lookout
Creek in St. Mary's county, for the purpose of being converted
into lime, under the penalty of ten dollars, to be recovered
before a justice of the peace.
