such, if he comes into this State; Provided, such free negro shall
not be detained out of this State by sickness or coercion.
50. The provisions of the last preceding section not to apply
to free negroes who may go and remain out of this State more
than thirty days between the first of May and first of November
in every year; Provided, such free negro shall obtain a permit in
writing, stating the purpose for which such negro is about to
leave this State, from the Orphans' Court of the county where
the negro resides, or if he resides in Baltimore, from the Criminal
Court of Baltimore, which permit shall be granted at discretion,
and only on the written recommendation of three respectable
white persons, known to be such by the judge or judges of said
court, and whose names shall be noted at the foot of such permit,
and the register of wills or clerk of the Criminal Court of Bal-
timore, shall file the recommendation among the papers of his
office, endorsing thereon the date of granting the permit.
51. No person shall hire, employ or harbor any free negro
who shall come into this State from any other State, district or
territory, under the penalty of twenty dollars for every day
after the expiration of four days.
VAGRANT FREE NEGROES.
52. Upon information given to the Orphans' Court, or any
justice of the peace, that any free negro, male or female, residing
in the county, is without visible means of support, the said court
or justice shall direct the sheriff, or any constable of said county,
to bring such free negro before such court or justice, and to
summon all necessary witnesses to inquire into the condition and
habits of such negro.
53. If upon examination the said court or justice shall be of
opinion that such free negro has not the necessary means of
support, and is not of good and industrious habits, the said court
or justice shall issue an order in writing, directed to the sheriff
or constable of the county, requiring such sheriff or constable
forthwith to sell such negro, on ten days' public notice, to the
highest bidder, to serve as a slave for one year.
54. Every purchaser of any free negro under the preceding
section shall, in addition to the price paid for such negro, find
him with good and sufficient food, lodging and clothing.
