other half to the sheriff, for the use of the Colonization Society
of the State of Maryland, to be recovered on complaint, and
conviction before the Circuit Court of the county, or the Cri-
minal Court of Baltimore, if he be arrested in the city of Balti-
more, or during the recess, before the Orphans' Court of said
county or city.

45. Any free negro refusing or neglecting to pay said fine,
shall be committed to the jail of the county or city, and shall
be sold by the sheriff at public sale, on ten days' notice, to the
highest bidder, whether such bidder be a resident of this State
or not, to serve as a slave.

46. After deducting the costs, charges, and a commission of
ten per cent., the said sheriff shall pay over one-half of the nett
proceeds to the informer, and the balance he shall pay over to
the Treasurer of the State, for the use of the Colonization Society
of the State of Maryland. ,

47. All sheriffs and constables are hereby required to arrest
any free negro who may come into this State contrary to the
provisions of this article, and all other persons are authorized
to arrest any such free negro, and such sheriff, constable or any
other person, who may arrest any such free negro, shall be
entitled to the penalty of twenty dollars hereby imposed, to be
recovered on complaint and conviction as before stated; and any
such free negro shall pay the said penalty of twenty dollars and
costs, and expenses incident to his arrest and detention, or upon
his failure to do so, he shall be committed and sold as herein
provided relative to those who have incurred the penalty of five
hundred dollars; Provided, that if said negro shall not remove
out of the State within five days after he shall have paid the
said sum of twenty dollars, he shall be deemed to have come
a second time into the State, and shall be liable as if he had so
done.

48. The preceding sections not to apply to any servant of a
white person coming to, or passing through this State by land
or water, if such servant remains with his master while here,
and leaves the State with him.

49. Any free negro who shall remove from this State, and
remain without the limits thereof more than thirty days, shall
be regarded as a resident of another State, and be punished as
