such commanding officers of corps, extra battalions or companies
as have disobeyed his orders to make out their muster rolls.
108. He shall annually in the month of November, or as soon
thereafter as possible, make out and transmit to the President or
other proper officer of the United States, a complete return of
the militia enrolled in this State, and shall obtain from the United
States the quota of arms and accoutrements to which this State
may be entitled.
109. He shall perform the duty of Armorer at the armory in
Annapolis. <
110. He shall furnish the captain of any uniform volunteer
company with such arms or accoutrements for the use of his
company as he may apply for, if the same be on hand or in any
of the armories of the State and not appropriated; Provided, the
adjutant general shall be satisfied that the company for whose
use the said arms and accoutrements are desired numbers at
least thirty-two men, and that it is duly organized and uni-
formed.
111. No arms and accoutrements shall be delivered to any
volunteer company unless the captain applying therefor shall
first execute to the State of Maryland and deliver to the adjutant
general his bond, with satisfactory security, and in such penalty
as the adjutant general may prescribe, conditioned for the safe
keeping, preservation and return or delivery of the said arms or
accoutrements to one of the armorers of this State within the
space of twenty days after the company for whose use they were
furnished shall have been dissolved or disbanded.
112. In case the arms and accoutrements furnished for the use
of any uniform volunteer company shall not be returned to one
of the armorers of this State within sixty days after such com-
pany shall have been dissolved or disbanded, the adjutant general
shall, in writing, request the officer in command of such company
at the time of its dissolution to return the said arms and accoutre-
ments to the State Armorers most convenient to the place where
such company was organized, and in case of his refusal or neglect
to comply within forty days after .the date of such request, the
adjutant general may cause suit to be brought on the bond given
to the State for the safe keeping and return of the said arms and
accoutrements.
