442 MILITIA. [ART. 63.
103. If in any year any officer whose duty it is to make any
division, brigade, regiment or company return to the adjutant
general, shall fail to do so for two months after the same shall
become due, the adjutant general shall certify the same to the
Governor, who shall thereupon revoke or cancel the commission
of the officer so failing; Provided, that whenever any officer
whose duty it shall be to make such return, shall not be able to
do so in consequence of the neglect or refusal of any officer to
make such reports to said officer as are required by law, or for
the want of such officers being in commission, he sbal} report
the fact to the adjutant general, who shall certify the same to
the Governor, which shall be deemed a compliance with the pro-
visions of this article, and the commission of such officer shall
not be revoked.
104. Each commissioned officer of the militia of this State shall
take the following oath in addition to the oath prescribed by the
Constitution, "I, A. B., do swear that I will be true and faithful
to the State of Maryland, and that I will diligently and faithfully
do and perform the several duties assigned me as ————— in the
militia of the State of Maryland, according to the best of my
skill and ability, so help me God," and a certificate of his having
done so shall be endorsed on his commission by the person who
shall have administered such oath.
105. All fines and penalties imposed under this article shall be
collected by the sheriff, and in cases where he is herein directed
to collect them by distress he shall do so, and where fines and
penalties are imposed by a court martial, the sheriff, on a certi-
ficate from such court martial of the imposition of the fine, shall
collect the same by execution, in the same manner as if such cer-
tificate were an execution issued by proper authority; and in all
other cases of fines, the sheriff shall collect the same by action
of debt in the name of the State before a justice of the peace of
his county, if the sum doe's not exceed one hundred dollars, and
if the same exceeds one hundred dollars, before the Circuit Court
for said county. All fines and penalties collected by the sheriff
under this article shall be paid to the Treasurer.
106. The adjutant general shall receive an annual salary of one
thousand dollars.
107. He shall report to the Governor on the first Monday of
January, annually, the strength of the militia, designating all
