which he removed or was enrolled, until he produces to the
commanding officer of said district a certificate from the com-
manding officer of the district into which he shall have so re-
moved, or from the commanding officer of said volunteer com-
pany, stating that he has been enrolled in his district or been
admitted into his uniform company.
63. No person shall be permitted to leave his company except
in the case aforesaid, unless he shall remove out of the limits
of a brigade, or unless commissioned in some other corps, with-
out the consent of the commanding officer, under a penalty not
exceeding twenty dollars, in the discretion of such court martial
as the case may require.
64. All resignations of commissioned officers shall be made
through the adjutant general, and at least sixty days prior to
the regular days herein appointed for the inspection, drill, or
making any annual enrolment or draught of the district militia
or volunteer corps to which such officer belonged, except in
cases of removal, and otherwise no officer shall be considered as
having resigned, except those who shall neglect to report them-
selves as herein directed, and every officer who may resign shall
immediately notify the commanding officer of his company, bat-
talion, squadron, regiment or brigade, as the case may be, of his
resignation, that the officer next in rank may be charged with
the duties of the office thereby vacated until the same shall be
filled.
65. Whenever any part or parts of the militia shall be
draughted and called into actual service, every person draughted
shall have a choice either to serve in person or find a sufficient
person as a substitute, which substitute shall be approved of by
the colonel or commanding officer of the battalion or squadron
to which he shall belong.
66. If any person not being disabled by sickness shall neglect
or refuse to serve or find a substitute within three days after
notice given to him, the colonel or commanding officer of the
battalion or squadron to which such delinquent belongs, shall
provide, hire or procure a substitute on as reasonable terms as
may be, and shall charge such sum, together with reasonable
expenses for procuring the same, to such delinquent, to be re-
covered by distress and sale of his goods and chattels, lands and
