56. Any officer summoned to attend as a member of a general
or division court martial who shall refuse or neglect to attend
at the time and place appointed, shall be fined a sum not exceed-
ing one hundred nor less than twenty-five dollars, unless he can
give a reasonable excuse to the court for such non-attendance.
57. Any officer summoned to attend a brigade court martial,
who shall refuse or neglect to attend at the time or place ap-
pointed, shall be fined not more than fifty nor less than ten
dollars, unless he can give a reasonable excuse for such non-
attendance.
58. Any officer summoned to attend as a member of a re-
gimental, extra battalion or squadron court martial, who shall
refuse or neglect to attend at the time and place appointed,
shall be fined not exceeding thirty nor less than five dollars,
unless he can give a reasonable excuse to the court for such non-
attendance.
59. Any officer summoned to attend as a member of a com-
pany court martial who shall refuse or neglect to attend at the
time and place appointed, shall be fined not exceeding ten nor
less than two dollars, unless he can give a reasonable excuse to
the court for such non-attendance.
60. Any non-commissioned officer or private summoned to
attend as a member of a company court martial, who shall
refuse or neglect to attend at the time and place appointed, shall
be fined not exceeding five nor less than one dollar, unless he
can give a reasonable excuse for such non-attendance.
61. Any commissioned officer removing out of the district of
his brigade, regiment, extra battalion or squadron, with an in-
tention of making a permanent change of his residence, shall
on removal be deemed to have resigned his commission, and the
commanding officer of the regiment, extra battalion or squadron
which he commanded or to which he belonged, shall report such
vacancy to the adjutant general, that the vacancy may be sup-
plied by the Governor.
62. If any militiaman shall remove out of the compaay district
in which he is enrolled into another district, or shall become a
member of any volunteer company, he shall continue subject to
all the duties that might be devolved on him in the district from
