418 MILITIA. [ART. 63.

any time appointed therefor by this article or any law of this
State, or shall neglect or refuse to attend any meeting ordered
agreeably to law, he shall forfeit and pay not more than two
hundred nor less than twenty dollars, or may be cashiered, at
the discretion of a general court martial.

13. If any non-commissioned officer or private shall neglect or
refuse to attend any meeting or perform any duty imposed upon
him by this article, or lawfully commanded by his company or
superior officer, he shall, if a non-commissioned officer, be
cashiered or punished by a fine in the discretion of a regimental
or battalion court martial, not exceeding ten nor less than two
dollars, and if a private, by a fine to be imposed by a company
court martial not exceeding five nor less than one dollar.

14. No militia fine shall be remitted in any case except by the
ofiicer authorized to approve and accept a satisfactory excuse,
or who ordered the court martial that imposed such fine, or
the Governor of the State, who may remit any militia fine at
pleasure.

15. There shall be appointed and commissioned one adjutant
general and one quarter master general in the militia of this
State; to each division, one major general and two aids-de-camp
with the rank of major, one inspector of and one quarter master
of division; to each brigade one brigadier general, with inspector
to serve as brigade major, and one quarter master of brigade, to
rank as majors; to each regiment one colonel, one lieutenant
colonel and one major, and a regimental staff to consist of one
adjutant and one quarter master, to rank as lieutenants, one pay-
master, one surgeon and one surgeon's mate, one chaplain, one
sergeant-major, one drum-major and one fife-major; to each extra
battalion or squadron, one major, and the same staff officers that
a regiment hath; to each company of infantry or riflemen, one
captain, one first lieutenant and one second lieutenant; to each
company of artillery, one captain and two lieutenants, and to
each company of cavalry, one captain and two lieutenants.

16. Whenever the office of major general, brigadier general,
colonel, lieutenant colonel, major, captain or lieutenant shall be
vacant, the officer next in rank shall exercise the command, and
perform the duties thereof until the vacancy shall be filled.
