religious society, pilots and their apprentices, marines actually
engaged in trade or sea-service, and all persons conscientiously
scrupulous of bearing arms, who shall produce to the captain
or commanding officer of the district proof that he is so eon-
scientious.
2. It shall be the duty of every captain or commanding officer
of a militia company annually in the month of April, or as soon
thereafter as possible, to appoint the non-commissioned officers
of his company, and to order them to enrol without delay every
able bodied white male citizen between eighteen and forty-five
years, who shall reside within the bounds of his company
district, and to notify said citizen of said enrolment by one
of the non-commissioned officers, by whom such notice may be
proved.
3. He shall designate in such enrolment all persons who are
under twenty-one from those who are over twenty-one years,
and in all cases of doubt respecting the age of any person
enrolled or intended to be enrolled, the person whose age is
questioned shall prove the same to the satisfaction of the officer.
4. If any person called on to be enrolled shall refuse to declare
his true name and age to the best of his knowledge, or the name
of any person an inhabitant of his house with which he is
acquainted, he shall for each offence forfeit and pay the sum of
five dollars, to be recovered by order and upon the certificate of
the said commanding officer as other fines and forfeitures are
herein directed to be recovered.
5. Every captain or commanding officer of a company shall,
in the month of May, or as soon thereafter as may be possible,
annually return to the commanding officer of the regiment or
battalion to which his company is attached, and shall also trans-
mit by mail to the office of the adjutant general, a correct enrol-
ment of the persons residing within the bounds of said company
liable to do militia duty, and upon his refusing or neglecting to
make either of said returns within said month in any year, he
shall be subject to a fine not exceeding fifty dollars for each
offence, unless he shall make a reasonable excuse to be approved
only by such officer.
6. No free white male citizen of the age of eighteen and under
forty-five years of age, shall be excused from militia duty on
