328 INEBRIATES. [ART. 46.

by ballot a president, vice president and secretaries of said Asy-
lum, who so long as they shall continue trustees of said Asylum
shall hold their offices respectively during the pleasure of the
board of trustees: they shall also annually elect a treasurer, who
shall hold office during the pleasure of the board and shall in the
discretion of said board of trustees give such bond for the faith-
ful discharge of his duties as they may deem proper; and said
trustees may also appoint from, their own body, or otherwise,
such other officers and agents as may be necessary or proper for
the purposes of the said institution: the said board of trustees
shall always have the power to fill vacancies in their own body
caused by the death, resignation or removal from the State of
Maryland, or otherwise, of any trustee or trustees, and any trustee
who shall be absent four consecutive meetings of the board may,
in the discretion of said board, be deemed and taken to have
resigned. The said board shall also have power to make all such
by-laws, not inconsistent with the laws of this State or of the
United States, as they may deem proper for the management of
the affairs of said Asylum. Five of the board of trustees shall
constitute a quorum for the transaction of business: all commit-
tees, physicians, agents and officers herein authorized, or author-
ized by the by-laws of this Asylum, shall be appointed by the
board of trustees.

5*. The said board of trustees shall have power to receive and
retain all inebriates who enter said Asylum either voluntarily or
are there placed by the order of any court or by the order of
the committee of any habitual drunkard, or if such drunkard
should be a minor, by the order of his or her parent or guardian;
and the said board of trustees are authorized and empowered to
employ all inebriates who are received into said Asylum in some
useful occupation in or about the said Asylum: said inebriates
shall have all moneys accruing from their labor after the expenses
of their support in said Asylum shall have been paid, which shall
be sent to their families monthly: in case said inebriates have no
families, it shall be paid to him or her at their discharge from
said Asylum.

6*. Whenever by petition under oath any person shall be alleged
to be a drunkard, incapable of taking care of himself or herself
or his or her property, any Circuit Court of this State, and also
the Superior Court of Baltimore city, shall have the power in its
discretion, on such preliminary examination or inquiry as it may
think proper to make ex parte, to issue a warrant to the sheriff
