326 HUSBAND AND WIFE. [ART. 45.

operate to the prejudice of any claim for the purchase money
of such lands, or other lien on the same.

6. A. tenant by the curtesy shall be entitled for life to lands
held by equitable title, but not to the prejudice of any claim for
the purchase money of such lands, or other lien on the same.

7. Any married woman who by her skill, industry or personal
labor shall earn any money, or other property, real, personal or
mixed, to the value of one thousand dollars or less, over and
above her debts, shall hold the same and the fruits, increase and
profits thereof, to her sole and separate use, with power as a feme
sole to invest, and re-invest and sell, and dispose of the same;
Provided, that such money or property shall be liable for the
payment of any claim or debt incurred by such married woman,
and be liable to be proceeded against by attachment from the
Circuit Court or Superior Court of Baltimore city upon petition
and proof of claim, according to the circumstances of each case,
or such property may be proceeded against in equity at the elec-
tion of the creditor.

8. Any married woman, by herself and in her name, or in the
name of any third person, with his assent, as her trustee, may
cause to be insured for her sole use the life of her husband, for
any definite period, or for the term of his natural life, and in case
of her surviving her husband, the sum or net amount of the
insurance becoming due and payable by the terms of the insur-
ance, shall be payable to her for her own use, free from the
claims of the representatives of her husband, or of any of his
creditors.

9 If the wife shall die before her husband, the amount of such
insurance may be made payable after her death to her children,
or descendants, for their use, and to their guardian if under age;
and if there be no children or descendants of the wife living at
the time of her death, to her legal representative

10. The receipt of any married woman for the payment of
money deposited by her before or after marriage, shall be a valid
discharge to any individual or corporation making such payment
Provided, that nothing contained in this section shall prevent any
creditors of the husband from attaching the same, or restraining
the payment by injunction, if the deposit were made in fraud
of creditors.
