SABBATH BREAKING.

178. No person whatsoever shall work or do any bodily labor
on the Lord's day, commonly called Sunday; and no person,
having children, servants or slaves, shall command, or wittingly
or willingly suffer any of them to do any manner of work or labor
on the Lord's day, (works of necessity and charity always ex-
cepted,) nor shall suffer or permit any children, servants or slaves
to profane the Lord's day by gaming, fishing, fowling, hunting
or unlawful pastime or recreation; and every person transgressing
this section and being thereof convicted before a single justice,
shall forfeit five dollars, to be applied to the use of the county.

179. No housekeeper shall sell any strong liquor on Sunday,
(except in cases of absolute necessity,) or suffer any drunkenness,
gaming, or unlawful sports or recreation in his house, on pain of
forfeiting twenty-five dollars, one-half to the State, and the other
half to the informer, to be recovered by action of debt, or by
indictment.

180. No person within this State shall sell, dispose of, or barter
any spirituous or fermented liquors or cordials of any kind, in
any quantity whatever, on the Sabbath day—commonly called
Sunday; and any person violating the provisions of this section,
shall be liable to indictment in any court of this State having
criminal jurisdiction, and upon conviction thereof shall be fined
a sum not less than twenty dollars nor more than one hundred
dollars, at the discretion of the court, for the first offence; and
if convicted a second time, for a like offence, the license of the
person so offending shall be declared null and void by the judge
of said court.

SENTENCE.

181. All claims to dispensation from punishment by benefit of
clergy are forever abolished; and every person convicted of any
felony heretofore deemed clergy able, shall be sentenced to under-
go a confinement in the penitentiary for any time not less than
eighteen months nor more than five years—except in those eases
where some other specific penalty is prescribed by this code.
And every person who shall be convicted of any felony heretofore
excluded from the benefit of clergy, and not specified in this
code, shall be sentenced to undergo a confinement in the peni-
tentiary for not less than five nor more than twenty years.
