246 CRIMES AND PUNISHMENTS. [ART. 30.

any dwelling house, warehouse, stable or out house, or in any
enclosed yard or garden, or area belonging to any house, with an
intent to steal any goods or chattels, every such person shall be
deemed a rogue and vagabond, and, on being convicted thereof,
shall be sentenced to the penitentiary for not less than eighteen
months nor more than two years.

RUNAWAYS.

174. Any negro slave, who shall escape or run away from the
service of his master or owner, against the will and consent of
his master or owner, with a view to escape e'ntirely from servi-
tude, and thereby to deprive said master or owner entirely of his
service, shall, upon sufficient evidence of such fact, be guilty of
felony. And the fact of the escape of any such negro slave into
any of the States or Territories of this "Union, without the con-
sent of his master or owner, shall be deemed conclusive evidence
that such negro slave left the service of his master or owner with
the intention of entirely depriving said master or owner of his
services.

175. Upon conviction of the offence described in the preceding
section, on an indictment by the grand jury of the county or city
from which such slave shall have escaped, the said slave shall be
sold after ten days' notice, by the sheriff of such county or city,
to the highest bidder; and after deducting the necessary expenses
for arrest, detention and conviction, the balance shall be delivered
to the master or owner of such slave; and the purchaser of such
slave shall give bond to the State in double the value of such
slave, conditioned to remove such slave from this State.

176. If any person shall entice, persuade, assist or offer any
inducement to any slave or servant, knowing him to be such, to
run away from his lawful owner or possessor, or shall harbor any
runaway slave or servant, knowing him to be such, he shall be
liable to indictment where such offence shall have been committed,
and upon conviction, shall be sentenced to the penitentiary for
not less than six nor more than fifteen years.

177. If any slave shall be convicted of any offence under the
provisions of the preceding section, such slave may, in the dis-
cretion of the court before whom such conviction shall be had, be
sentenced to be sold out of the State, or to receive on his bare
back any number of lashes not exceeding forty.
