BUT NOT PROPER TO BE INCORPORATED.                                                        185

CHAP. 30.  An act ascertaining the rates of foreign coins in her majesty's plantations
in America.

From the title and from the provisions in this statute, it appears that it was to have its operation
in the province; and it was mentioned in the act of 1708, Ch. 4, which is referred to in the Deputy
Commissaries Guide, p. 20.

CHAP. 37.  An act for the encouragement of the trade to America.

See the note on Ch. 30, first part.

7 Anne.--A. D. 1708.

-----

CHAP. 5.  An act for naturalizing foreign protestants.

See the note on 25 Edw. 3, St. 2.  From the relation in which the subjects residing in Great-Britain
stood with regard to the subjects residing in the province, it is evident that this statute which declared
that the children of all natural born subjects, born out of the liegance of her majesty, &c.
should be deemed, adjudged, and taken to be natural born subjects of the kingdom, extended to
the province.  I find this statute noticed in the proceedings of the Upper House, respecting an act
for naturalization that was proposed in 1760, as follows:  " Provided that nothing in this act shall
extend to naturalize any persons who, by an act of parliament, 4 Geo. 2, entitled, An act to explain
a clause in an act made in the 7th year of queen Anne, for naturalizing foreign protestants, (which
relates to the children of natural born subjects of the crown of England or Great-Britain,) are declared
not to be entitled to the benefit of the said act of 7th Anne; but that all such persons shall be
and remain in the same plight and condition as they would have been if this act had not been made."
See the note on 13 Geo. 2, Ch. 7.
It is to be observed also, that the statute 29 Charles 2, Ch.6, had declared, that all born out of the
king's dominions between the 14th of June 1641, and the 24th of March 1660, whose fathers or mothers
were natural subjects, were natural born subjects to all intents; but that statute having expired,
I have not inserted it.  There were a great number of acts of assembly, for the naturalization
of particular persons, commencing in 1666, which did not however prevent the extention and operation
of the British statutes; but they are not proper to be incorporated, &c.

8 Anne.--A. D. 1709.

-----

CHAP. 13.  Customs.--Funds.--Plantations.--Tobacco.

The part of this statute relating to tobacco, extended to the province.

9 Anne.--A. D. 1710.

-----

CHAP. 27.  An act for the encouragement of the trade to America.

    Expired.
