Statutes made at Westminster, 28 Edw. 3.--A. D. 1354.

CHAP. 1.  A confirmation of all statutes before made and used.

    This statute was in force with the parts of the great charter which were so.

CHAP. 13.  The warranty of packing of wool shall be put out.--An inquest shall
be de medietate linguæ where an alien is party.

    The first part of this statute was by no means applicable to the province; but it appears that the
latter part was so, although cases under it were not likely to occur often.
    In 1748, there was an indictment against negro Jem for murder.  It is stated in the record of the
proceedings, that advantage was given by consent of the attorney-general, as if he had pleaded to
the jurisdiction of the court, being an alien.  The said James alleged that he was a foreigner, and
therefore prayed a jury half denizens and half aliens. Wherefore, according to the form of the
statute, the sheriff was commanded to cause twelve, &c. of which one half to be aliens and the other
moiety denizens.  There was a similar proceeding against another person at the same court.
    The act of 1789, Ch. 22, S. 5, states that " whereas no special provision is made by the laws of this
state, for the trial of aliens and foreigners, for offences committed against the laws of this state, and
doubts may hereafter arise, whether aliens and foreigners may not be entitled to a trial per medietatem
linguæ
," and provides that they shall be tried in the same manner as other persons.  There is a
similar provisions in the act of 1809, Ch. 138, S. 15.
